PLEASE TAKE NOTICE that the Board of Directors (the Board) of the Regional District of Central Kootenay (RDCK) approve staff to proceed with obtaining approval of electors in Electoral Areas A, B, and C for the adoption of the Dangerous and Aggressive Dog Control Service Establishment Bylaw No. 3067, 2026.

PURPOSE:
The bylaw, if adopted, will established a service for the regulation of dangerous and aggressive dogs.

AREA:
The proposed service area will include Electoral Areas A, B, and C.

RATE IMPLICATIONS:
The proposed maximum annual allowable requisition for the service is $90,000 or 0.033/$1,000 of taxable assessed value of land and improvements, whichever is greater.

ALTERNATIVE APPROVAL PROCESS (AAP):
Under Section 86 of the Community Charter, approval of the electors within the service area is being sought by means of an AAP. Therefore, eligible electors within the service area opposed to the RDCK adopting Bylaw No. 3067 may petition against the adoption by signing an Elector Response Form.

At least 10% of electors must petition against the proposal prior to the deadline date in order to prevent the Board from adopting the Bylaw.

The Board has resolved that a fair estimate of the number of electors in the subject area is 7,674. Accordingly, pursuant to Section 86 of the Community Charter, 767 or more electors must sign the Elector Response Form to prevent the Board from proceeding.

ELECTOR RESPONSE FORMS:
The Elector Response Form must be in the form established by the Board and are available by clicking on the links below or can be picked up at the following RDCK offices:

RDCK Nelson Office: 202 Lakeside Drive, Nelson

RDCK Creston Office: 531 16th Ave S, Creston

RESIDENT ELECTOR RESPONSE FORM (is a resident of Electoral Areas A, B or C)

NON-RESIDENT ELECTOR RESPONSE FORM (is a non-resident property owner in Electoral Areas A, B or C)

WHO MAY SIGN THE ELECTOR RESPONSE FORM:
Electors, either resident or non-resident, within the boundaries of the service area are entitled to sign and submit an Elector Response Form. Resident and non-resident elector qualifications are described on the Elector Response Form.

DEADLINE:
Following the formal initiation of the AAP process on May 7, 2026, the Elector Response Forms must be received by the Chief Elections Officer before 4:00 p.m. on June 15, 2026.
